Citation : 2022 Latest Caselaw 2437 Chatt
Judgement Date : 12 April, 2022
HIGH COURT OF CHHATTISGARH, BILASPUR
Order Sheet
Cr.M.P. No. 71 of 2022
Karamchand Patel Versus Bodheshwar Prasad Rathore
12.04.2022 Shri Sanjay Agrawal, counsel for the Petitioner.
Shri Amit Kumar, counsel appears along with Shri Rajendra Kumar Patel, counsel
for the Respondent.
Heard on I.A. No.01/2022, an application seeking exemption from filing depositions
as well as exhibited documents on record.
Shri Agrawal does not want to press the said application as the record itself has
been called and the documents are the part of it.
Accordingly, the said application is rejected as not pressed and disposed of.
Heard on an application filed under Section 378(4) of the Cr.P.C. seeking leave to
appeal against the judgment dated 12.11.2021 passed in Complaint Case No.51/2016 by
learned Judicial Magistrate First Class, Raigarh (C.G.).
After examining the aforesaid judgment impugned, I am inclined to allow this
petition.
The petition is accordingly allowed and the petitioner is permitted to prefer an
appeal against the said impugned judgment.
CRMP, thus, stands disposed of.
Registry is directed to register the case as a regular appeal under the head "Acquittal Appeal" and list the matter thereafter for its admission.
