Heard on I.A. No. 03/2021 which is an application filed

under Section 389(1) for suspension of sentence and grant of bail.

By the impugned judgment dated 22.03.2021 passed by the

learned Additional Sessions Judge, Patthalgaon, District Jashpur

(C.G.) in Sessions Case No. 07/2020, the appellant stands

convicted as under:-

                  Conviction                         Sentence

             U/s 342 of IPC         R.I. for 1 year with fine of Rs. 100/- with
                                    default stipulation.

             U/s 302/34 of IPC      R. I. for life imprisonment with fine of Rs.
                                    1,000/- with default stipulation.

             U/s 302/201 of IPC     R.I. for 5 years with fine of Rs. 1,000/- with
                               default stipulation.




Learned counsel for the appellant would submit that the

appellant is innocent and has been falsely implicated in this case.

Furthermore, nothing has been seized from the possession of

appellant. The appellant is a lady aged about 48 years, therefore,

she may be enlarged on bail.

On the other hand, learned State counsel opposes the

argument advanced by learned counsel for the appellant.

Heard counsel for the parties and perused the material

available on record.

Having considered the submissions made by the parties,

facts and circumstances of the case and, particularly, the

statements of Jugan Sai (PW-2) and Dara Singh (PW-4) recorded

before the trial Court, we are of the considered opinion that the

present is not a fit case to release the appellant on bail.

Accordingly, I. A. No. 03/2021, application for suspension of

sentence and grant of bail is rejected.
