                    Heard on I.A. No. 01/2021, application for condonation of delay
              in filing the instant Criminal Miscellaneous Petition.

                    Upon due consideration the same is allowed.

                    Delay is condoned.

                    Heard on Cr.M.P. followed by acquittal appeal preferred against
              the judgment dated 22.02.2020 passed by the Judicial Magistrate
              First Class, Raipur, District-Raipur (C.G.) in C.I.S. No. 19426/2015
              whereby and whereunder learned trial Court acquitted the accused of
              charges framed under Sections 323, 294 and 506-II of the IPC.

                    On due consideration, this Court is of the view that special
              leave to appeal may be granted. Consequently, the present Cr.M.P. is
              allowed. Registry is directed to list the matter under the head of
              acquittal appeal.

                    Record of the Court below be called.

                    On petitioner's paying process fee within 10 days, notice along
              with a copy of acquittal appeal be issued to the respondent through

registered and usual mode, returnable within 4 weeks.

List the matter for further hearing after service to respondent is complete and record is available.
