Learned counsel for the Petitioner submits that the petitioner is entitled to get the interim bail/parole in view of the judgment passed by the Hon'ble Supreme Court in Writ Petition (C) No.1 of 2020 on 7 th May, 2021. He also draws the attention of this Court on the decision taken by the High Power Committee constituted by the High Court, precisely Clause 6, as under:-
"6. Under trial prisoners (UTPs) facing trial in a case under Section 307 IPC and are in jail for more than six months; subject to the condition that he should not be involved in any other case which prescribes punishment of more than 7 years:"
Learned counsel for the State submits that now normalcy is restored, therefore, the guidelines may not be applicable in the present case.
The petition being arguable is admitted for hearing on the question that whether the guidelines of the High Power Committee dated 12.05.2021 are applicable now or not.
List the matter on 4th August, 2021.
