For the delay occurred in filing the petition for which an application has been filed by the petitioner for condonation of delay in filing the petition. Counsel for the respondent fairly submits that as per the judgment passed in SMW(C) No. 03/2020, the supreme Court has excluded the period 15/03/2020 to 02/10/2021 for delay
In the order dated 01/12/2021 passed by this Court, counsel for the petitioner had submitted that after excluding the lock down period, the petition has been filed within time.
As per the Registry note, after re-verification there is no delay in filing the petition and the petition is filed within time. Therefore, in view of the above, I.A. No. 01/2021 application for condonation of delay in filing the petition is disposed of.
This CRMP is filed under Section 378 (4) of the Code of Criminal Procedure, 1973 for grant of Special Leave.
Upon due consideration leave is granted.
Registry is directed to register the case as an acquittal appeal.
Heard on admission.
Admit.
Since the counsel for the respondent has already appear, no need to pay PF and also to issue notice.
Call for the record.
Post the matter for final hearing in due course.
