This is an office reference based on the request letter dated 10-8-2021 sent by the 5th Additional District Judge, Ambikapur, Distt. Surguja, for extension of additional time to dispose of Civil Appeal No.35A/2021.

This Court by judgment dated 7-2-2020 passed in S.A.No.248/2010 directed the first appellate Court i.e. the 5th Additional District Judge, Ambikapur to dispose of the first appeal within three months from the date of receipt of copy of the order, but the 5th Additional District Judge, Ambikapur has now sent this request letter seeking further time to dispose of the first appeal.

Considering the fact that the matter has not been disposed of, further one month time from the date of receipt of a copy of this order is granted to dispose of the first appeal. Let the matter be taken-up on day-to-day basis by the learned 5th Additional District Judge. However, the District Judge, Surguja (Ambikapur) is directed to find out why the judgment dated 7-2-2020 passed in S.A.No.248/2010 could not be complied with right in time and report the same to this Court along with complete order sheet (photocopy / true copy), particularly the date of receipt of record till this date and order sheets of all the dates within 4 weeks from today.

The matter be listed for consideration on 20-9-2021.
