The Court: Affidavit of service filed in Court today is taken on record.
The defendants have remained unrepresented on several occasions in the
past when the matter was called on. By an order dated 20 th January, 2026, the
plaintiffs were directed to make a further service. On a perusal of the affidavit of
service, it appears that the defendants have been served through registered post.
It was made clear in the order dated 20th January, 2026 that in the event the
defendants remain unrepresented on the next date despite notice the matter will
be taken up in the absence of the defendants. There is, as such, no embargo in
taking up the matter in the absence of the defendants.
The plaintiffs commence their arguments but the same could not be
concluded.
Since the defendants remain unrepresented, the learned Senior Advocate
representing the plaintiffs has submitted that his clients will produce the
document relating to the registered office address records of the defendant no.5
which is a private limited company from the official website of the Registrar of
Companies. Let such documents be produced on the next date.
The plaintiffs shall serve a copy of this order upon the defendants.
Let this matter appear on 12th February, 2026.
