Leave is granted to the Advocate-on-record of the petitioners to affirm

the supplementary affidavit and file the same in the department.

Supplementary affidavit is handed over to the learned advocate

representing the Railways in Court today.

2. As regards page 69 of the supplementary affidavit the petitioners have

annexed a document in respect of the submission that the rakes in

respect of indent nos.405, 406, 407 and 408 are pending before the

Railways. Upon allotment of rakes and loading of materials, bills will be

raised by the Railways for payment by the petitioners. Only after the

Duplicate Carbon Receipt copy in respect of the subject stone materials

to be transported is produced before the authority, Railways will permit

the rakes to be transported.

3. The Railways are directed to allot rakes to the petitioners by 27th

February, 2026. Upon allotment of rakes, the petitioners will be

permitted to load the stone materials. Payment for the allotment of

rakes shall be made upon the amount being made known to the

petitioners. The Railways will permit the petitioners to transport the

goods only after production of original DCRs in respect of the goods to

be transported.

4. Relist the contempt application on 16th March, 2026.

5. All parties shall act on the basis of a server copy of this order duly

downloaded from the official website of this Court.
