The Court : An interim report termed as 'Initial Enquiry report'
dated 13th February, 2026 prepared by the Block Land and Land
Reforms Officer, Barrackpore-II, North 24 Parganas (hereinafter
referred to as 'the BL&LRO') and placed before the Court is taken on
record. On a perusal of the said report it appears that the entire
property of 218 cottahs is demarcated by a boundary wall. Inside the
main boundary wall there are separate partition walls constructed by
the petitioner (plaintiff) and the respondents (defendants) to which
there are no registered partition deed as per the petitioner. The
partitioned portions inside the main premises are occupied by the
petitioner and the respondents. The report also mentions that the
developed area forming part of the main premises is 40 cottahs
approximately and not 36 cottahs as contended by the petitioner. The
defendants say that the plaintiff and his group at the highest have
1/3rd share out of 218 cottahs. Out of that 40 cottahs have been got
developed by the plaintiff without even the partition takes place. The
plaintiff is holding on to much excess land that the residual amount
in the said premises. The plaintiff on the other hand says that the
defendants are enjoying almost in entirety the other property of the
estate at Nalini Ranjan Sarkar Street, Kolkata and as such they are
more interested in the Dakshindhari property. BL & LRO, however,
has cited difficulty in carrying out the survey work because of the
ongoing Special Intensive Revision of Electoral Roll (in short 'SIR'). The
work related to SIR as reported by media relying upon public
statements of officers will come to an end in a short while.
The concerned BL & LRO, therefore, is directed to complete the
survey work by recording the area within the various partition walls
inside the main premises and who is in possession thereof. The
concerned BL & LRO shall also provide in the survey report as to what
extent of land is claimed to be under possession of the plaintiff and
that under the defendants. Let the report be filed by 24 th March, 2026.
It is expected that the concerned BL & LRO shall take all necessary
steps to complete the survey work prior to the next date as a
considerable period has elapsed during the interregnum.
Let this matter appear on 27th March, 2026.
