Court is informed that affidavit in reply has also been served.
However, none appears for the applicant.
At this juncture, Ms. Suchismita Ghosh (Chatterjee), learned
advocate appearing for the plaintiff submits that though there has been an
application served having been allegedly registered as IA GA-COM/10/2025
but on inspection of record, the plaintiff has come to know that there is no
such application on record filed by the defendant no. 4. However, this
application is not in the list today.
In view of the above, it appears that because of pendency of the
above applications, the suit is not in a position to be proceeded with. It is
noted that the applicants are not represented also for pressing their
applications.
For the ends of justice, one last opportunity is granted.
The plaintiff shall serve a notice along with a copy of this order upon
the respective applicants in the above applications. It is made clear that if
on the next day, the applicants are not represented, respective application/s
shall be dismissed for default. It is made clear that no adjournment shall be
granted on those applications. The plaintiff shall file an affidavit of service
on the next day.
The matter shall appear under the heading "Chamber Applications
for Final Disposal" on April 28, 2026.
