  1. Mr. Kumarjit Banerjee, learned Counsel, is appearing for the

     plaintiff.

  2. None appears on behalf of the defendant.

  3. Counsel for the plaintiff submitted in view of the judgment passed by

     the   Hon'ble    Appellate   Court   dated   6th   January,    2025.     GA-

     COM/1/2024 is to be heard afresh. Accordingly, he prays for fixing

     the matter on a specific date and time.

  4. This Court perused the judgment passed by the Hon'ble Appellate

     Court dated 6th January, 2025 in AO-COM/2/2025 with CS-

     COM/565/2024, wherein in paragraph 18. The Hon'ble Division

     Bench has passed the following order.

     "18. Since the application for judgment upon admission and injunction

     was heard and the said matter was made C.A.V., we request the

     learned Single Judge to decide the said application on merits and till
                                        2



        such time, the respondent no.1 shall not deal with its assets and

properties without the leave of the learned Single Judge. In the event

security is furnished for an amount of Rs.3,37,15,075/- the embargo

shall stand automatically vacated."

5. This Court finds that the application filed by the plaintiff being GA-

COM/1/2024 was dismissed by an order dated 18.11.2024. Under

such circumstances the Counsel for the plaintiff submitted that he

will take appropriate steps for correction of the said order before the

Appellate Court.

6. Let the matter appear on 5th August, 2025 at 11:30 A.M.
