The Court:-Mr. Abhrajit Mitra, learned Senior Advocate appearing
through virtual mode submits that as per the decree passed in the suit the
decree holder is entitled to mesne profit of Rs.10,52,65,304/-. He also indicates
that though appeal has been filed by the judgment debtor challenging the
decree but there is no persuasion of the judgment debtor to have the appeal
heard.
It is informed that a copy of affidavit-in-opposition has been served
upon learned Advocate for the decree holder. However, it is found from the case
record that such affidavit-in-opposition is not available.
For the reasons as aforesaid, matter stands adjourned.
Department concerned is directed to place such affidavit-in-
opposition, if filed, in the record on the returnable date.
List this matter on 28th August, 2024.
Learned Advocate for the decree holder is directed to intimate the
next date of hearing to the learned Advocate for the judgment debtor.
