Mr. Majumder, learned advocate, appears on behalf of
the petitioner and challenges the continuance of the proceedings.
Mr. Mukherjee, learned Public Prosecutor opposes the
same.
Having regard to the stage of the proceedings that the
charge-sheet has already been submitted in connection with the
instant case and warrant of arrest has been issued against the
present petitioner, I direct that during the pendency of the present
revisional application if the petitioner appears on 19th October,
2023 before the learned ACJM, Bishnupur, Bankura in connection
with Sonamukhi Police Station Case No. 8 of 2023 dated
13.04.2023 and prays for bail. The warrant of arrest issued by the
learned court in such circumstances following the judgment of the
Hon'ble Supreme Court in Inder Mohan Goswami and another Vs.
State of Uttaranchal and others reported in (2007) 12 SCC 1 be
treated as bailable warrant. Learned Magistrate accordingly on
surrender would decide the application for bail in accordance with
law.
