The Court:- Mr. R.N.Jhunjhunwala moved GA No. 1040 of 2018.

However, the application is not placed before this Court. Mr. Sengupta, learned

Counsel appearing for the judgment-debtor submitted that there is order of

the Supreme Court to send all connected applications along with the record to

the Hon'ble Supreme Court. The report of the learned Registrar, Original Side

does not reflect that GA No. 1040 of 2018 has been sent. That record has not

been placed before this Court too. A report is called for from the learned

Registrar, Original Side in this regard. Report shall be submitted before this

Court on 16th October, 2023. Mr. Jhunjhunwala also submitted that he has

not received a copy of the report of the Special Referee which is supposed to be

handed over to him. However, Mr. Sengupta candidly admitted that a copy has

already been received by him. Let the Special Referee serve a copy of report to

Mr. Jhunjhunwala before the next date. A copy of this order may be

communicated to the Special Referee.

Let the matter appear in the list on 16 th October, 2023 for further order.
