NB Ct. 39 WPA 19063 of 2022
Usuf Biswas
Vs.
The State of West Bengal & Ors.
Mr. T. Hossain.
...for the petitioner.
Mr. Debajyoti Basu,
Mr. Diptomoy Talukder.
...for the respondent no.5.
Mr. Sirsanya Bandopadhyay, Mr. Arka Kumar Nag.
...for the State.
In reply, learned counsel appearing on behalf of the
petitioner takes up an additional point that the application made
by the private respondent was not for compassionate
appointment, but for a fresh dealership.
Learned counsel for the State submits that this
application was rejected. It was only after an appeal was filed
by the concerned respondent for compassionate engagement in
the peculiar circumstances that her husband and the husband's
brother died from Covid 19 that such prayer was considered.
Learned counsel for the private respondent submits
that such technicalities should not come in the way of
substantial justice.
Heard the learned counsels for the parties.
Hearing is concluded and judgment is reserved.
Urgent photostat certified copy of this order may be
supplied to the parties expeditiouly, if applied for.
