                              Affidavit of service filed in Court is taken on record.

                              In spite of service, the respondents are not represented. The

respondent nos. 1 and 2 are the beneficiaries.

The report of the Superintendent, SR Section, dated 17th

November, 2022 is erroneous as the application for condonation

of delay has been filed on 22nd September, 2022. Consequently,

the report filed by the learned Registrar Administration (L&OM)

is also erronuous to the aforesaid extent.

Insofar as the other defects are concerned, it appears that the

names of the respondent nos. 2 and 3 are mentioned in the cause

title of the impugned judgment.

In view of the aforesaid, the Additional Stamp Reporter

shall filed a revised report by the adjourned date.

We direct the Secretary, Calcutta High Court Legal Services

Committee to appoint an Advocate to represent the respondent

nos. 1, 2 and 3 within 48 hours from the date of communication of

this order by the learned Registrar Administration (L&OM) and

also to establish contact with the respondents through the

Secretary, District Legal Services Authority concerned.

The matter stands adjourned for one week.

The Secretary, Calcutta High Court Legal Services

Committee shall file a report with regard to compliance of this

order by the adjourned date.

The petitioner shall serve copies of memorandum of appeal

and the applications upon the Secretary, Calcutta High Court

Legal Services Committee by tomorrow.

An affidavit of service shall be filed on the adjourned date.

This order shall immediately be communicated to the

learned Registrar Administration (L&OM) for doing the needful.
