This appeal is directed against a judgment and

order which was passed by a learned Single Judge

yesterday (January 30, 2023). The appellant's writ

petition assailing an order under Section 400(3) of the

Kolkata Municipal Corporation Act, has been

dismissed. The order is still not on server.

We are told that today is the date fixed for

demolition of the alleged unauthorized structure.

Since this appeal is pending before us and since the

order impugned is not available till now, it would be in

the fitness of things to direct the Corporation to stay

its hands till day after tomorrow (February 2, 2023).

List the matter on February 1, 2023 once again.
