This appeal is directed against a judgment and
order dated 9.2.2022, whereby the appellants' writ
petition being WPA No.4165 of 2018 was dismissed.
The appellants had approached the learned
Single Judge praying for a direction on the respondent
authorities to pay compensation to them for
acquisition of their land as per the modified award of
the Kolkata Improvement Tribunal. Learned Advocate
for the appellants says that the writ petition was
dismissed only on the ground of delay.
We need to hear out the appeal. We are told that
all papers that were available before the learned Single
Judge have been annexed to the stay petition. The stay
petition should be treated as an informal paper book.
All formalities are dispensed with.
Since the State is not represented today, learned
Advocate for the appellants will communicate to
learned Advocate representing the State that this
matter shall be listed under the heading "Hearing"
fairly at the top on 31.1.2023.
