Ms. Sanyal, learned counsel appears on behalf of the

respondent no. 2/the West Bengal State Agricultural

Marketing Board.

Mr. Moniruzzaman, learned counsel appearing on

behalf of the petitioner submits that the petitioner's prayer

for compassionate appointment has not been considered by

the respondent no. 5/District Magistrate on the erroneous

ground that she was not unmarried prior to the date of death

of the deceased employee of the Board. The District

Magistrate also directed that the Hon'ble Court's order

should be followed and the petitioner's prayer should be

forwarded to the respondent no. 2/Board.

Ms. Sanyal submits that the representations dated April

17, 2018 and May 3, 2018 on behalf of the petitioner may be

considered afresh by the Chief Executive Officer (CEO) of the

respondent no. 2 in accordance with the judgment reported in

2017 (4) CHN (Cal) 362 (State of West Bengal vs. Purnima

Das).

After hearing the submissions of the parties this Court

directs the representations to be considered by the CEO of the

Board/respondent no. 2 or any person authorized by him

within eight weeks from date upon giving a personal hearing

to the petitioner and be disposed of by passing a reasoned

order.

Let the reasoned order be communicated to the

petitioner within two weeks of passing thereof.

With the directions aforesaid, W.P.A. 19287 of 2022 is

disposed of.

All parties shall act on the server copy of this order

duly downloaded from the website of this Court.

Urgent photostat certified copy of this order, if applied

for, be given to the parties upon compliance of all the

formalities.
