An arguable case has been made out by the petitioner
as to whether the occupational charges should be paid by the
judgment debtor when the judgment debtor prays for stay of
the execution, during the pendency of the application under
Order 9 Rule 13 of the Code of Civil Procedure.
There shall be stay of all further proceeding in Misc.
Case No.43 of 2023, which is pending before the learned
Civil Judge (Senior Division) at Barasat upto December 31,
2023.

The petitioner is directed to serve a copy of this
revisional application along with a server copy of this order
upon the opposite parties as also upon the learned advocate
