W.P.A. No. 249 of 2023
CESC Limited
Vs.
Coal India Limited & Ors.
Mr. Shounak Mitra,
Ms. Shivangi Thard
...for the petitioners
Mr. Chayan Gupta,
Mr. Varun Kedia,
Mr. Avee Jaiswal
...for the respondent no. 1
Mr. Tilak Bose, Mr. Sudhakar Prasad ...for the respondent no. 2
It is rightly pointed out by learned counsel for
the parties that in paragraph no. 61 of the
judgment and order dated March 31, 2023, it was
erroneously recorded that the respondent no. 1-CIL
chose to remain absent when the interim order of
this court was passed.
However, it is seen from the records as well as
in paragraph no. 6 of the judgment dated March
31, 2023 itself, that the CIL was represented on the
date when the interim order was passed.
Hence, let the first sentence in paragraph no.
61 of the judgment dated March 31, 2023 be
deemed to stand corrected to the effect as follows:
The expression "but chose to remain absent
when the interim order of this court was passed"
stands deleted.
This order be deemed to be a part of the order
dated March 31, 2023.
