This is an application for expeditious disposal of G.R. 4656/2021

arising out of Santragachi Police Station Case No.75 of 2021 dated 19th

August, 2021 under Section 498A of the IPC.

It is submitted on behalf of the petitioner that the petitioner has

been working in WIPRO as Senior Manager (HR). He has got a chance of

working in abroad. However, due to pendency of the above mentioned

case it is not possible for the petitioner to leave the country. Under such

peculiar facts and circumstances, a direction may be directed to the

learned Judicial Magistrate to dispose of the case expeditiously.

I have heard the learned advocate for the petitioner. On perusal of

the materials on record, it is found that in the instant case charge was

framed on 13th April, 2022. During this one year 5 witnesses have been

examined out of 8 charge-sheeted witnesses. Only 3 witnesses remained

to be examined. On perusal of the course of the criminal proceeding

being conducted by the learned Judicial Magistrate, this Court is of the

view that there is no laches on the part of the learned Judicial Magistrate

where this Court can grant an order of expeditious hearing of the above

mentioned case.

However, the petitioner no.1 has prayed for expeditious disposal of

the G.R. Case No.4656/2021 on the ground that if the case is disposed

of, he may get an opportunity to go abroad to pursue his job.

Considering such aspect of the matter, the learned Judicial

Magistrate, 3rd Court, Howrah is directed to conclude the hearing of the

case within three months from the date of communication of this order.

The application is thus disposed of.

The petitioner is at liberty to act on the server copy of the order.
