Mr. Mrityunjoy Chatterjee, learned advocate, appears on
behalf of the respondent no.2/victim.
Mr. Saryati Datta, learned advocate, appears on behalf of
the State.
It has been pointed out by Mr. Chatterjee, learned
advocate appearing for the respondent no.2/victim that in respect of
the same trial the learned special court under the POCSO Act, the
victim has preferred a revisional application being CRR 3940 of
2022.
Having regard to the fact that the subject matter of the
judgment involved is same, while the accused/appellant is praying
for acquittal, the complainant or on behalf of the victim a prayer
has been advanced in revision for enhancement of the sentence, as
such I am of the opinion that the appeal and the revision must be
heard by one and the same Court.
Let the records be placed before the Hon'ble Chief Justice
for assignment this appeal and the revisional application on a
particular single Bench.
