Abantika Acharyya
Vs,
Chanchal Acharyya
Mr. Nilanjan Bhattacharjee,
...for the appellant.
Re: CAN 10038 of 2019 (maintenance) filed on September 27, 2019.
The appellant is the wife. The appellant is aggrieved by
the judgment and decree passed by the learned District Judge at
Howrah in a suit for dissolution of marriage solemnised between the
parties being Matrimonial Suit No. 463 of 2013. The learned
District Judge dismissed the suit.
The wife/appellant filed the instant application praying
for alimony pendente lite. The learned advocate for the appellant
submits that the appeal may be disposed of as expeditiously as
possible and the appellant, in that event, shall not press the
application for alimony pendente lite and for other reliefs claimed in
CAN 10038 of 2019.
We feel that the appeal should be heard out as
expeditiously as possible. Accordingly, the appeal is directed to be
listed for hearing on June 30, 2022. Requisite number of paper
books is to be filed in the meantime, if not already filed.
Office is directed to place the complete records of this
case on the adjourned date.
The application for maintenance pendente lite is
dismissed as "not pressed" without, however, any order as to costs.
