We have heard learned counsel for the
parties. We order unconditional stay of the
execution of the impugned judgment and decree
dated 17th May, 2014 and the order of
attachment dated 20th April, 2022 till 19th May,
2022.
If, in the meantime, the appellant bank
furnishes an automatically renewable bank
guarantee by itself in favour of the learned
Registrar General of this court for Rs. 1.30
Crore, the stay would continue till disposal of the
appeal or until further order, whichever is
earlier.
Furnishing of the bank guarantee shall be
upon intimation to the respondent.
In default, the respondent would be free to
proceed with the execution.
We are told that the appeal is ready for
hearing and the paper books have been filed.
List this appeal for hearing fairly at the top
on 15th June, 2022.
The application (CAN/3/2022) is disposed of.
