The petitioner alleges violation of the direction

passed in the order dated 5th December, 2019.

When the contempt application was taken up for

consideration on 16th June, 2022, submission was made

on behalf of the contemnors that an appeal in a similar

matter was pending consideration before the Hon'ble

Division Bench. Adjournment was sought for on that

ground.

Today an order dated 4th July, 2022 has been

placed before this Court passed in MAT 750 of 2022 with

IA No.: CAN 1 of 2022 with IA No.: CAN 2 of 2022.

It appears therefrom that the Hon'ble Division

Bench was pleased not to interfere with the judgment

and order passed by this Court in similar matters.

No appeal has been preferred by the contemnors

challenging the order passed in the present writ petition.

In view of the above, the contemnors are duty

bound to comply the order that has been passed by the

Court.

The contemnors shall refund the amount which

was deducted from the retiral dues of the petitioner along

with interest positively within 25th August, 2022.

In the event said amount is not disbursed in favour

of the petitioner within the aforesaid date then the

contemnor no.2 shall remain personally present in Court

on 25th August, 2022.

The order dated 4th July, 2022 passed in MAT 750

of 2022 be retained with the records.

Instruction given by the Managing Director, West

Bengal State Minor Irrigation Corporation Ltd. dated 13 th

July, 2022 in connection with CPAN 635 of 2020 arising

out of WP 15854 (W) of 2019 in the matter of Tapan

Kumar Dutta vs. State of West Bengal & Ors. be also

retained with the records.

Urgent photostat certified copy of this order be

supplied to the parties, if applied for, as early as possible.
