This is an application for expeditious disposal of a NDPS case under Section 21(C) of the NDPS Act being Case No. N-179/2019 pending before the learned Additional Sessions Judge, NDPS Act, 6 th Court at Barasat.
It is submitted on behalf of the petitioner that in connection with the aforesaid case pending in the Trial Court, trial has already been concluded and next date is fixed for examination of the accused under Section 313 of the Code of Criminal Procedure. Under such circumstances, the petitioner has prayed for a direction upon the Trial Court for expeditious disposal of the instant case. Having heard the learned Advocate for the petitioner, this Court finds that the Case No. N-179/2019 is presently pending for examination of the accused under Section 313 of the Code of Criminal Procedure on 6 th January,
2023. After examination of the accused under Section 313 of the Code of Criminal Procedure if the accused does not examine any witness on behalf of the defence, the case will straightway fix for argument and delivery of judgment. It is expected that the said case shall be disposed of by February, 2023.
Therefore, I do not find any merit in the instant revision and accordingly the instant revision is dismissed summarily.
