dated 20th July, 2022 passed by Learned Judge,

Presidency Small causes Court, 3rd Bench submitting

that the Court below has mechanically issued writ of

possession giving a complete disregard to the Misc

Case No. 40 of 2017 challenging an ex parte decree

granted in this case, and Misc Case No. 56 of 2019

pertaining to the proposed substitution on the demise

of the sole judgment debtor.

The core issues may be best addressed upon

securing presence of the opposite parties.

Petitioner is directed to serve the copy of the

application upon the opposite parties and their

learned advocates appearing in the Court below, by

speed post with A/D, and furnish affidavit of service

on the next returnable date.

List the matter on 5th September, 2022 at the

top under the heading 'New Motion 1'.
