The matter was made C.A.V on 10th August, 2022. Subsequently, this matter was mentioned by Mr. Aniruddha Chatterjee, learned counsel representing the respondent, with a prayer to make further submission in this matter. In view of such request, with the consent of the appellants, the matter is listed today for further hearing.

Mr. Chatterjee has relied upon Halsbury's Laws of England, 7th Edition, Vol-103, paragraph 895 and a judgment of the Hon'ble Supreme Court in Niranjan Umeshchandra Joshi Vs. Mrudula Jyoti Rao & Ors., reported in 2006(13) SCC 433, paragraphs 18, 20, 22, 33 to 36. An adjournment is prayed for on behalf of the appellants to distinguish the said decisions relied upon by Mr. Chatterjee.

The matter stands adjourned till tomorrow, i.e. 26th August, 2022.

The parties shall be at liberty to file short law notes along with compilation of judgments by tomorrow.

The order dated 10th August, 2022 is recalled, further hearing is given to the parties, as it recorded that "Hearing is concluded, the judgment is reserved."
