Debangshu Malik Versus Sova Rani Malik nee Jana and another

The revisional application was preferred against the

judgment and order dated 15th July, 2008 passed by the learned

Judicial Magistrate, Dantan at Paschim Midnapore in connection

with M.R. Case No.308 of 2005 corresponding to T.R. Case No.192

of 2009.

The grievance of the present petitioner is in respect of

amount of maintenance awarded which was aggregated to a sum of

Rs.1500/- per month (Rs.900/- per month to the wife and Rs.600/-

per month to the minor son). By the same order, the learned court

was also pleased to award a sum of Rs.1500/- towards litigation

cost.

Having regard to the subject matter of the revisional

application and the assessment by way of which the learned

Judicial Magistrate awarded maintenance, I am of the view that no

interference is called for regarding the finding. Further, the

quantum so awarded was by taking into account the cost expenses

of the period between 2005 to 2009. With the passage of time, the

cost index has completely changed. Accordingly, no interference is

called for in respect of the award granted by the learned Judicial

Magistrate. Thus, no interference is called for.

Accordingly, CRR 3033 of 2009 is dismissed.

Pending application, if any, is consequently disposed of.

Interim order, if any, is consequently vacated.

All parties shall act on the server copy of this order duly
