The present revisional application has been
preferred against the judgment and order dated
03.04.2013 passed by the learned Additional District and
Session Judge, First Court, Bankra in Criminal Appeal
No. 13 of 2012.
The Subject matter of challenge before the learned
appellate Court related to the order dated 13.03.2012
passed by the learned Judicial Magistrate, 3rd Court,
Bishnupur, in Misc. Case No. 20 of 2011/67 of 2011
wherein the learned Magistrate was pleased to allow the
application filed under Section 12 of the Protection of
Women from Domestic Violence Act, 2005. Records of
the appellate court reflects that appellate court has
assessed the evidence both documentary and oral and
thereafter arrived at its finding thereby affirming the
order passed by the learned Judicial Magistrate, 3rd
Court, Bishnupur.
Having regard to the same, I am of the opinion that
no issues have been raised in the revisional application
which requires fresh consideration for interference in
respect of any illegality.
Accordingly, the revisional application being CRR
3496 of 2013 is dismissed.
Pending application, if any, in connection with the
revisional application, is consequently disposed of.
Interim order, if any, is hereby vacated.
All concerned parties are to act in terms of a copy
of this order duly downloaded from the official website of
this court.
