Mr. S. K. Panja,
Mr. Sumit Ray,
...for the petitioners.
Mrs. Anwari Quraishi,
Mrs. Zainab Tawur,
...for the State.
Affidavit of service filed by the petitioners is taken
on record.
Heard learned counsels for the parties.
It is not in dispute that against the order of the
learned Land Acquisition Judge under Section 18 of the
Land Acquisition Act, 1894 an appeal has been preferred
by the State authorities. No stay has been granted in the
said appeal. An execution case in terms of the judgment
under Section 18 of the 1894 Act is also pending.
Learned counsel appearing for the State
respondents has challenged the maintainability of the
writ petition on the ground that the petitioners have the
liberty to ventilate their grievances before the Appellate
Court as well as the Execution Court.
Learned counsel for the petitioners seeks
accommodation to take instructions in the matter.
Let the matter appear under the heading "For
Orders" on 8th April, 2022.
