Writ petitioner could not qualify TET 2014

held in the month of October, 2015. Writ petitioner

seeks the benefit of the order passed by a

coordinate Bench on 3rd October, 2018 on writ

petition being W.P. 23006(W) of 2017 whereby the

coordinate Bench directed the West Bengal Board

of Primary Education to award marks to the

petitioner/petitioners who attempted wrong

question/options in the key answers of JGB

question booklet series. Against this order dated 3rd

October, 2018 passed by the coordinate Bench

intra court appeal has been preferred by the Board

being MAT no. 1594 of 2018.

Mr. Biswas, learned advocate representing

the Board submits that the said intra court appeal

is still pending.

Meanwhile the Hon'ble Apex Court passed

an order on 1st April, 2019 in Special Leave to

Appeal (C) No(s).5945/2019 (Basir Ahmed -vs-

Pravita Mondal & Ors.) thereby directing that along

with appeal preferred by the Board the writ

petitions which are pending or to be filed by the

candidates seeking benefit of the judgment of the

coordinate Bench dated 3rd October, 2018 to be

heard by a Division Bench. The said order of the

Apex Court dated 1st April, 2019 is placed before

this Court by Mr. Ratul Biswas.

In view of the order passed by the Apex

Court on 1st April, 2019, this writ petition needs to

be heard along with the intra court appeal being

MAT no. 1594 of 2018 by the Division Bench.

Writ petitioner shall be at liberty to take

necessary steps.
