In course of hearing of this case, it has been brought to the

notice of this Court that some States like the State of Rajasthan,

State of Kerala and the State of Maharashtra have issued some

circulars regarding conducting preliminary enquiry before

registration of F.I.R. following the judgment reported at (2014) 2

SCC 1 (Lalita Kumari Vs. Government of Uttar Pradesh &

Others) delivered by the Supreme Court.

The Joint Commissioner of Police (Crime), Kolkata Police,

shall file a report before this Court disclosing whether any similar

circular has been issued by the State of West Bengal following the

aforesaid judgment of the Supreme Court.

Let such report be filed on September 14, 2021.

In the meantime, there shall be a stay of all further

proceeding of Golabari Police Station Case No. 231 of 2021 dated

July 20, 2021, under Sections 498A/323/406/506/34 of the

Indian Penal Code, 1860, and Sections 3 & 4 of the Dowry

Prohibition Act, 1961.

List this matter for further hearing at 2.00 p.m. on

September 14, 2021, under the same heading.
