We admit this appeal from the judgment and

decree dated 28th June, 2018 passed by the learned

court below. We propose to hear out this appeal

dispensing with all formalities.

As the respondents are represented in court

issuance and service of the notice of appeal is dispensed

with.

Advocate-on-record for the appellants will

prepare an informal paper book and file the same

in this Court by 20th September, 2021 serving a copy

thereof on the advocate-on-record for the

respondents at least seven days before the date fixed for

hearing of the appeal.

According to the calculation handed up to this

court by learned counsel for the respondents, the total

amount payable by the appellants to the respondents

under the decree, as on 15th August, 2021, is Rs.

58,35,027.55.

Taking into account accrual of interest pending

hearing of the appeal, provided the appellant Union of

India furnishes security to the extent of Rs. 60 lacs with

the learned Registrar General of this court by way of a

bank draft issued by a nationalised bank by 30th

September, 2021, there shall be an unconditional stay

of the decree till 30/9/21 and this stay shall continue

till disposal of the appeal or until further order. In

default, the respondents shall be free to execute the

decree.

The learned Registrar General shall encash the

bank draft and invest the same in a short term fixed

deposit earning the highest interest in a nationalised

bank to the credit of the appeal.

The stay application (CAN 2 of 2021) is disposed

of.

List the appeal for hearing on 15th November,

2021.
