In the matter of : Sk Iliyas .... Petitioner

Lower Court record has been received by the department. On examination the department found certain defects as to the marking of some documents as exhibits and also with regard to the exhibited documents. The instant appeal arises from a judgment passed by a the learned Additional District and Sessions Judge, Special Court , Dakshin Dinajpur at Balurghat.

From the Office report it is found that file of the lower Court record containing petitions, Vakalatnama, Haziras etc. was not sent with the record.

The said documents are not relevant for hearing of the appeal. The department is directed to treat the record as complete and take steps for preparation of paper book.
