Learned advocate for the petitioner submits that this matter is covered by a judgment delivered by this Court in WPA 10789 of 2021 (Abhijit Ghosh Vs. State of West Bengal & Ors.) on 9th July, 2021. However, I have been told that in this matter there is an appeal court's judgment dated 20th July, 2021. Therefore, this judgment and order delivered by me on 9th July, 2021 does not have any separate an independent existence after passing of the appeal court's judgment in MAT No. 638/2021.
In view of the above the petitioner has the liberty to follow the appeal court's judgment as has been stated above.
With these observations this writ application is disposed of.
