The Court : This appeal from a judgment and order dated

5th January, 2021 of a learned single Judge of this Court, is

formally admitted.

The appeal has to be heard out.

As all the parties are represented by learned counsel, we

dispense with issuance and service of the notice of appeal.

All other formalities are also dispensed with.

As suggested, let an informal paper book be prepared and

filed in this Court by 15th March, 2021, serving a copy

thereof on each of the contesting parties, on usual terms at

least three days before the date of hearing of the appeal.

List the appeal for hearing on 24th March, 2021 fairly at

the top.

We are not, at this stage, minded to interfere with the

interim order dated 5th January, 2021, except that if the

appellant wants to induct new tenants or change the terms of

any tenancy of existing tenants, they may only do so upon

obtaining a proper order from this Court on an application.

This order is strictly subject to any order that may be

passed in the next appeal preferred by the plaintiff in APOT

No.23 of 2021, which was taken up today for consideration.

Hearing of the stay application could not be concluded.

The application, GA/1/2021 is disposed of.

(I. P. MUKERJI, J.)

( MD. NIZAMUDDIN, J. ) pkd.
