The Court: Sufficient cause is shown. The delay in preferring the appeal is
condoned in view of the inconvenience suffered by the litigants, including the
appellant, during the COVID-19 crisis of 2020.
This appeal against the judgment and order dated 17th January, 2020 passed
by a learned single judge in a disclaimer application of the appellant under section
535 of the Companies Act, 1956 is admitted.
It is necessary at this stage to ascertain the exact nature and extent of the
demised property on the ground floor of premises no.43, Jorbagh, New Delhi, of
which the company, now in liquidation, was the lessee/tenant.
The official liquidator will file an affidavit to this effect by 26th February, 2021.
Rejoinder, if any, may be filed by the appellant by 5th March, 2021.
List the appeal and the application on 8th March, 2021 as 'New Application'.
