In re: An application under Section 374(2) of the Code of Criminal Procedure, an order and judgment dated 27.08.2014 passed by the learned Additional Sessions Judge, Fast Track Court-II, Howrah, in S.T. No.217 of 2009 arising out of Sankrail P.s. Case No.231/08 dated 23.06.2008 under Sections 417/120B/376/506 I.P.C. convicting the accused under Section 376 of the IPC.

It appears from the record that Mr. Dipankar Aditya and

Ms. Karabi Roy appeared on behalf of the appellant on 5 th

February, 2015. Subsequently the appellant remains

unrepresented. It is also found from the record that the

appellant was enlarged on bail vide order dated 5 th February,

2015 inspite of issuance of rule for enhancement of sentence

vide order dated 24th November, 2014. As the appellant

remains unrepresented, order of bail granted on 5 th February,

2015 be cancelled and the learned Chief Judicial Magistrate,

Howrah is directed to issue warrant of arrest against the

appellant to suffer sentence in connection with S.T. NO.217 of

2009, disposed of by the learned Additional Sessions Judge,

Fast Track Court No.II, Howrah on 27th August, 2014.

The learned Chief Judicial Magistrate, Howrah and the

learned Trial Judge be informed accordingly for compliance of

the order.
