The learned advocate for the petitioner submits that

the issue in question has already been put at rest in the

judgment dated 28th May, 2021 passed by the Hon'ble

Division Bench of this Court in MAT No. 1917 of 2019 (The

State of West Bengal - vs - Rabindra Nath Ghosh).

It has further been submitted that the appeal number

as mentioned in order impugned i.e. MAT 927 of 2019 has

been withdrawn by the appellant/State and the same is

reflected in the order dated 24th September, 2021.

The learned advocate for the State seeks time for

taking necessary instruction in the matter.

Let the matter appear in the list on 16th December,

2021 as "For Orders".
