In terms of the direction on 24th November,
2021, the advocate for the State produces a bunch of
documents.
Referring to a memo dated 16th September,
2021 and a note appearing at the 3rd page of the said
bunch, it is submitted by the State that so far as
absorption and/or regularisation of the petitioner's
service is concerned, a decision has been taken
keeping in mind the judgment in the case of
Secretary, State of Karnataka & Ors. v. Umadevi (3) &
Ors., reported in (2006) 4 SCC 1. So far as the other
issue is concerned, a decision, according to the State,
is pending regarding the payment to the petitioner
from December, 2001 to December, 2016.
Let this bunch of documents be brought on record
by the State through a report in the form of an
affidavit. Let such affidavit be filed within 20th
December, 2021.
Let this matter appear on 10th January, 2022.
The petitioner shall be free to file an exception to
the report, if advised, in the meantime.
