It appears from the case record that despite

issuance of several administrative notices to the parties

and endeavours made by this court, none of the parties

has shown any interest to proceed with the appeal.

This appeal has been preferred by the appellant

being aggrieved by the judgment dated 22nd September,

1990 passed by the learned Chief Judicial Magistrate,

Darjeeling in C.R.Case No. 15 of 1988 under Sections

500/504 of the Indian Penal Code. By the judgment the

learned Trial Judge acquitted the respondent of the

complaint under Sections 500/504, Indian Penal Code.

After reading the judgment of the court below

minutely I find that the learned Trial Judge rendered the

judgment on proper appreciation of the evidence both oral

and documentary.

What I feel, the judgment of the learned trial court

does not suffer from any illegality or infirmity.

As such, I find no reason or justification to interfere

with the judgment.

In view of the above, the appeal is dismissed.

The judgment dated 22nd September, 1990 passed by the

learned Chief Judicial Magistrate in C.R.Case No. 15 of 1988 is hereby

confirmed.

Let a copy of this order along with the Lower Court

records be sent down to the learned Court below.

The appeal is disposed of accordingly.

Xerox certified copy of this order, if applied for, be

given to the parties on urgent basis.
