The learned advocate representing the petitioner

submits that a similar issue is already pending

consideration before the Hon'ble Division Bench where

hearing has been concluded and judgment reserved.

An order dated 22nd January 2021 passed in WPA

11052 of 2020 (Md. Rashed Molla - vs- The State of West

Bengal & Ors.) has been placed before this Court.

It appears therefrom that the Court requested the

State authorities not to proceed in the matter as the same

notification was being considered by the Division Bench.

As the issue in the instant writ petition appears to be

the same, the direction passed in the order dated 22 nd

January, 2021 is passed herein. The State is requested not

to proceed in the matter awaiting order from the Hon'ble

Division Bench. List the matter once against on 10 th

November, 2021.
