The petitioner has filed the instant application for bail under Section 439 of the Code of Criminal Procedure after being arrested in connection with Case No.N53/2021 arising out of NCB Crime No.12/NCB/KOL/2021 dated 07.04.2021 under Section 8 read with Section 20(b)(ii) ( C )/29 of the N. D. P. S. Act.

Two conflicting Division Bench judgments are placed before us by the respective Counsels and it is submitted by Mr. Basu, learned Senior Advocate appearing for the petitioner that the same requires to be considered in depth and prays for an accommodation in this regard.

In view of the above, let this matter be listed as 'For Orders' on 23rd August, 2021.
