1. Issue notice to the respondents, returnable on 16th June, 2026.

2. Ms. Prachi Joshi, learned A.G.P. waives service of notice on behalf of respondent No.1.

3. Mr. Tejas Deshpande, learned counsel waives service of notice on behalf of respondent Nos.2 and 3.

4. Notice to be served to the remaining respondents by all modes permissible in law including regular mode of service.

5. It is the contention of the learned counsel for the petitioner that the tender which was initially floated on 25.03.2026 was withdrawn on 5.5.2026. However, the said tender is subject matter of challenge in Writ Petition No.2760/2026 wherein the Division Bench of this Court has directed as under :

"In the meanwhile, if the respondents proceed in pursuance of the aforesaid tender notice dated 25.03.2026, the same shall be subject to outcome of the present writ petition."

6. In that view of the matter, similar order is passed that the respondents are permitted to proceed in pursuance to the tender dated 5.5.2026. However, same shall be subject to outcome of the present writ petition.

7. To be heard along with Writ Petition No.2760/2026.
