Applicants as well as the learned Counsel appearing for Respondent

No.2, submit that the complainant was to get married with accused

no.1 and since there was likelihood of marriage, certain amounts were

exchanged. Today, both the parties agree that if the accused persons

pay that amount, the complainant would not press for dismissal of the

bail application of the Accused No.1. They submit that the matter is

settled between them out of the Court.



3)              Mr. Mayur Sonavane, the learned A.P.P. for Respondent No.1-

State submits that as the matter is settled out of the Court, he on

instructions of Officer who is present in the Court, submits that the

custodial interrogation is not required. Both the parties have informed

the Court that they are settling the matter amicably and further, Mr.

Thakare, learned Counsel appearing for the Applicants has tendered

the demand draft of Rs.25,00,000/- to the learned Counsel appearing

for the Respondent No.2. Mr. Shah, the learned Counsel appearing for

the Respondent No.2 acknowledges the same. Mr. Thakare, the learned

Counsel for the Applicants submits that the parties              agree that the

balance amounts of Rs.42,00,000/- will be paid within a period of six

months from today, in six equal installments. Mr. Shah, the learned

Counsel for the Respondent No.2 has agreed for this suggestion. In

light of this, he does not object to the Application for anticipatory bail

at this moment. He submits that after all the amounts are paid, the

parties would move jointly for quashing of the FIR.



4)              Since, the entire transaction arose from the marriage proposal

between the accused no.1-Jay Brahmbhatt and Respondent No.2, and

further since the parties have amicably settled the matter, I am inclined

to protect the Applicants at this juncture. Hence, I pass the following

Order :-



                                         :ORDER:

(i) In the event of arrest, the Applicants-Avani

Dineshbhai Brahmbhatt and Manthan Avani

Brahmbhatt be released on bail in connection with

C.R. No.538/2026, registered with Malad Police

Station, Mumbai, dated 4th April 2026 for offences

punishable under Sections 3(5), 318(2), 318(4),

319(2), 340, 351(2), 315(4), 69 of the Bharatiya

Nyay Sanhita, 2023 and 66(C) 66(D) of the

Information Technology Act, 2000, on executing P.R.

Bond in the sum of Rs.25,000/- each, with one or

two sureties in the like amount.

5) Stand over to 7th July, 2026.
