1. Ms. Rishika Harish, learned Advocate for the Petitioner tenders a

copy of the Draft Amendment to the Leave Petition (L) No.17611 of 2026.

Draft Amendment is taken on record. Amendment in terms of the Draft

Amendment shall be carried out forthwith. Re-verification is dispensed

with.

2. By the present Suit, the Plaintiff seeks to challenge the Defendant's

action dated 10th April 2026, whereby the Plaintiff's official and business

Instagram handles, namely, @deltin_life, @deltinroyale, @deltin.jaqk,

@deltinsuites, @thedeltindaman, @deltindenzong and @deltacorplimited

have allegedly been disabled without any prior notice or intimation to the

Plaintiff. It is the Plaintiff's case that the aforesaid Instagram handles

constitute important business and promotional platforms through which

the Plaintiff engages with its customers and disseminates commercial and

brand-related content. Despite correspondence, the Defendant has not

restored the aforesaid Instagram Handles causing great loss and prejudice

to the Plaintiff.

3. At paragraph no.26 of the Petition, the Plaintiff has pleaded that a

material part of the cause of action has arisen within the jurisdiction of this

Court. In particular, paragraph no. 26(b) states that the impugned

Instagram handles hosted and published content on the Instagram

platform, which was accessible, viewable and interacted with by users

within Mumbai and within the territorial jurisdiction of this Court. I am

satisfied that the accessibility and dissemination of the impugned digital

content within Mumbai are sufficient to invoke the jurisdiction of this

Court under Clause XII of the Letters Patent. As part of the cause of action

has arisen within the jurisdiction of this Court, the Petition is allowed in

terms of prayer clause (a) which reads as under:-

"(a) That this Hon'ble Court be pleased to grant leave under Clause XII of the Letters Patent to institute the said Suit against the Respondent."
