1. Heard.

2. The revision application is preferred by the original accused challenging the Judgment passed by the Trial Court as well as the Appellate Court for the offence punishable under Section 138 of the Negotiable Instrument Act, 1881.

3. Today, the accused as well as the complainant are present in the Court. Mr. Bhamburkar appears for the original complainant and makes a statement that he has instruction to appear for the complainant. Mr. Bhamburkar filed a Vakalatnama, which is taken on record. The Office is directed to register the Vakalatnama.

4. Since, both the parties have stated that matter is already settled, the same is decided with the consent of the parties at the admission stage itself.

5. Both the learned Counsels as well as the complainant and accused who are present in the Court have submitted that the matter is settled and the complainant has received an amount of

Rs.2,72,000/- (Rs. Two Lakhs Seventy Two Thousand only) by way of Demand Draft.

6. In view of the receipt of the amount of Rs.2,72,000/-, the complainant, who is present along with his Counsel submits that he has no objection if the Judgments impugned are set aside or the parties are permitted to compound/settle the matter.

7. Both the parties have tendered a copy of Joint Application for recording compromise on record, which is marked as "X" for identification.

8. In view of the terms and conditions of the settlement and as the parties have entered into an agreement, the Criminal Revision Application is allowed.

9. The Judgment and order dated 12.03.2026 passed by the learned District Judge-9 and Additional Sessions Judge, Nagpur in Criminal Appeal No.202/2023 as well as the Judgment and order dated 04.05.2023 passed in Summary Criminal Case No.1839/2020 are hereby quashed and set aside.

10. The accused stands acquitted for commission of offence punishable under Section 138 of the Negotiable Instrument Act, 1881.

11. The bail bonds of applicant stand cancelled.

12. The Criminal Revision Application stands disposed of accordingly.
