AWARD

1. The dispute between the parties having been referred for

determination to the Lok Adalat.

3. The Appellant - Insurance Company tendered a withdrawal

pursis. The entire amount under the Appeal has been deposited by the

Appellant - Insurance Company. The Appellant - Insurance Company is

withdrawing the Appeal unconditionally. Hence, the First Appeal stands

disposed of in terms of the withdrawal.

4. The withdrawal pursis is taken on record and marked as "X" for

the purpose of identification.

5. The amount, if any, deposited by the Appellant - Insurance

Company shall be paid to the Respondents.

6. The Appellant - Insurance Company shall intimate the

withdrawal of this Appeal to the Respondents - Claimants personally or

through its Advocate on record.

7. C. F. refund certificate be issued as per the Rules.

8. Civil Applications, if any, also stand disposed of.

9. The Registry shall intimate the withdrawal of this proceeding to

the Motor Accident Claims Tribunal.

9. The parties are informed that the Court fee, if any, paid by any

of them, shall be refunded.
